Terms and Conditions

In this Agreement you are referred to as the “User" and USA Estate Plan, LLC is referred to as “USA Estate Plan".

PLEASE READ ALL OF THE TERMS AND CONDITIONS.

USER and USA Estate Plan agree to all the following Terms and Conditions:

1. The User understands and agrees that USA Estate Plan does not provide any legal, financial or tax advice and the User assumes full responsibility for the preparation, administration and all other aspects of the User’s estate plan.
2. The User understands and agrees that USA Estate Plan provides only forms and that USA Estate Plan is not the substitute for an attorney, and that if the User has any legal questions, USA Estate Plan recommends that the User contact a qualified attorney in User’s state.
3. The User understands and agrees that Estate planning laws vary from state to state in the United States, and legal advice may only be given by a licensed attorney, and USA Estate Plan is not a licensed attorney nor a substitute for a licensed attorney. Estate planning laws vary from state to state in the United States, and will change.  The User understands and agrees that it is User’s sole responsibility to determine and keep up to date on the current laws of the User’s state and determine whether the general forms offered by USA Estate Plan are appropriate for the User’s state, now and at all times in the future.  USA Estate Plan does not guarantee that its forms are appropriate for the User’s state or circumstances, and will not send you any further communication to update you on any of the laws or the appropriateness of these general forms for your circumstances.
4. The User understands and agrees that USA Estate Plan provides general forms for Married with Children, Married Without Children, Single With Children and Single Without Children, and it is the User’s full responsibility to select and complete the input for the proper form. USA Estate Plan does not guarantee that its forms are valid for User’s state, and User assumes full responsibility for such determination.
5. The User understands and agrees that the use of a USA Estate Plan’s site, and all applications of it, is for individuals who are U.S. Citizens and who have a total estate value not to exceed One Million Dollars ($1,000,000.00) now or at anytime in the future, and if the User’s total estate value exceeds One Million Dollars ($1,000,000.00) now or at anytime in the future, USA Estate Plan is not to be used and the User is advised to seek qualified legal counsel in your state and have a new estate plan prepared by such counsel.
6. The User represents that he or she is at least eighteen years old, has full capacity and is not under any duress or undue influence in the use of USA Estate Plan’s site or any application of it.
7. The User understands and agrees that the use of a USA Estate Plan’s site is done by the User himself or herself, and the User is not acting for or on behalf of any other person.
8. The User understands and agrees that the User is required by these Terms and Conditions to use arbitration of any disputes with USA Estate Plan or any person or entity affiliated with USA Estate Plan, and that the User hereby acknowledges, agrees and waives any right to a trial by jury or judge and to any class action lawsuit.
9. The User understands and agrees that USA Estate Plan is not an attorney and that any information provided to USA Estate Plan does not create a attorney-client relationship, and that USA Estate Plan does not and will not represent the User, or the User’s successor trustees or executors in any legal proceedings.
10. The User understands and agrees that USA Estate Plan site, and all applications of the site and all forms are copyrighted material and that the User shall not download, disseminate or in any other way use any of the forms in any unauthorized manner that would violate privacy, copyright, trademark or any other applicable law.
11. If you do not agree with all of the terms and conditions as set forth hereinabove, please do not use this site or any application of it.
